This is the latest issue of the ABIC Major Works contract, launched in 2018, and can only be used for housing projects. Under the Building Work Contractors Act 1995 (Act), projects for domestic building work with a contract price of more than $12,000 must use a compliant form of contract, like the MW H SA.

The MW contract should be selected to suit each individual project, taking account of its complexity, value and any specific project issues or requirements. Compared to the Simple Works (SW) contract, the MW also provides contract mechanisms for:

+urgent instructions +separable parts to the works (staged practical completion) +change of type of security +security from owner to contractor +dangerous or contaminated materials +encroachments +quality assurance systems +separate contractors.

The MW H SA also provides a mechanism for the owner to pay the contractor a deposit. The deposit amount is a pre-payment of the contract price, capped to limits specified in the Act. Under the Act, “domestic building work” is constructing, erecting, underpinning, altering, repairing, improving, adding to or demolishing a house including the site preparation.

If the project is the owner’s home, or multi-unit housing to be sold by the owner, domestic building work is involved.

A house is generally a building intended as a residence, but there are exceptions. Hotels, boarding houses usually providing temporary accommodation are not a ‘house’. If the project is residential but provides temporary accommodation, the builder or the owner should get legal advice about whether the Act applies to the project.

Included in this contract pack is 3 copies of the contract and an Information Statement for the Owner (the Form 1—Your Building Contract: Your Rights and Obligations is included in the contract).
